Floyd Grand Jury to hear Allen ‘road rage’ case

ALLEN — The Floyd County Grand Jury will determine whether charges will be filed in a “road rage” incident that led to one man being shot Sunday at Allen.

Prestonsburg Police 911 dispatchers took multiple calls around 4 p.m. Sunday of a shooting that occurred at the Stumbo Park-Beaver Valley Golf Course parking lot in Allen, according to a press release. Prestonsburg officers, supervisors, and Kentucky State Police troopers responded to the scene.

When they arrived, Larry Mullins of Allen was seated outside of his pickup truck in the parking lot of the park and golf course, the release said.

“Mullins was identified as the shooter who had secured his firearm in his truck,” the release said. “Mullins stated that he had been involved in a ‘road rage’ type of incident along KY Route 1428 that originated a short distance down the road that led to the Golf Course and ultimately the shooting.”

The park and golf course were “heavily populated with patrons of those facilities who were independent of either party involved in the altercation and were eye witnesses to it,” the release said.

Prestonsburg officers and KSP troopers conducted interviews of those witnesses and learned that “some sort of road rage incident occurred between the parties prior to arrival at the golf course and observation by independent witnesses,” the release said.

A blue truck operated by Mullins entered the parking lot and parked, witnesses told police, and an additional vehicle came into the area at a high rate of speed and parked behind Mullins’ truck, the release said.

Inside the second vehicle was Christopher Shane Sword, who exited and approached the blue truck, opened the door and began a physical altercation with Mullins, the release said. Multiple witnesses “confirm they observed Sword striking Mullins,” the release said.

“Mullins brandished a firearm, a struggle for that firearm ensued, and Mullins discharged it two times, the first shot did not strike anyone and the second struck Sword in the abdomen,” the release said. “Sword and the vehicle he came in fled the scene to Martin Our Lady of The Way ARH so Sword could reasonably seek medical treatment. Mullins remained at the scene and awaited the arrival of Police.”

All evidence collected at the scene, including the firearm and spent shell casings, will be presented to the Floyd County Grand Jury, the release said.

“Floyd County Commonwealth's Attorney A. Brent Turner was contacted and a joint decision between his office and Police was made to allow all facts and evidence to be presented to the Floyd County Grand Jury for consideration of criminal charges and justification of use of force as self-defense, and Mullins was released pending their decision,” the release said.
